Terms of Service
1. Acceptance of Terms
By accessing or using Atlas Fantasy (the "Platform"), operated by Atlas World Sports, Inc. ("Atlas," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. Atlas reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age (or 21 in jurisdictions where required) to use the Platform. You must be located in a jurisdiction where fantasy sports contests are legal. Atlas reserves the right to verify your identity and eligibility at any time. Employees, officers, and directors of Atlas World Sports, Inc. and their immediate family members are not eligible to participate in paid contests.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify Atlas immediately of any unauthorized use of your account.
4. Fantasy Sports Contests
Atlas Fantasy offers games of skill, including but not limited to Confidence Pools, Pick 'em Pools, Survivor Pools, Square Pools, and Season Long Fantasy leagues. Contest results are determined by the statistical performance of athletes in real sporting events. All contest rules, scoring systems, and prize structures are published on the Platform prior to contest entry. Atlas reserves the right to cancel, modify, or suspend any contest at its sole discretion.
5. Fees and Payments
Certain contests may require entry fees. All fees are clearly disclosed before you enter a contest. Prize payouts are subject to applicable taxes and withholding requirements. Atlas may deduct a service fee from contest prize pools as disclosed in the contest rules. Refunds are issued at Atlas's sole discretion in accordance with our refund policy.
6. Prohibited Conduct
You agree not to: (a) use automated scripts, bots, or other software to interact with the Platform; (b) collude with other users to gain an unfair advantage; (c) create multiple accounts; (d) engage in any form of cheating, fraud, or manipulation; (e) use the Platform for any illegal purpose; (f) interfere with or disrupt the Platform's infrastructure; or (g) violate any applicable laws or regulations.
7. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, trademarks, and software, is the property of Atlas World Sports, Inc. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Platform without prior written consent from Atlas.
8. Data and Privacy
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. Sports data provided on the Platform is sourced from Stats Perform and other licensed data providers. You acknowledge that real-time data may be subject to delays or inaccuracies.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS WORLD SPORTS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. ATLAS'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ATLAS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Cook County, Illinois.
